Use of this website and/or purchasing a product/service from Hoopsie Dizzy (Anne-Marie Bollier, sole trader) constitutes your agreement to the Terms outlined below.
You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms at anytime. It is your responsibility to check this page periodically for changes that may affect you.

BOOKINGS AND PAYMENTS
Bookings must be made in writing, using the Hoopsie Dizzy Booking Form or email. All bookings require a 50% non-refundable, non-transferable deposit or a Purchase Order number to be confirmed. Where a PO number is supplied, the total amount will be invoiced after the event. Where a 50% deposit is paid, the balance will be invoiced and payable as follows:
- private parties & corporate events: prior to the delivery of the entertainment and payable at least 3 business days before the event
- council: following delivery of the entertainment and payable within 2 weeks
Workshops are capped at 15 people per facilitator unless negotiated in advance.
Hoopsie Dizzy will only commence executing custom costumes, choreography, LED hoop designs and other tailored programming on receipt of a 50% deposit or supplied PO.
CANCELLATION AND POSTPONEMENT
Hoopsie Dizzy understands that life and weather can be unpredictable, especially here in Far North Queensland. Postponement is considered if Hoopsie Dizzy receives a reasonable postponement request at least 48 hours before the event. Hoopsie Dizzy will endeavour to meet postponement requests without financial penalty, depending on entertainer availability for the new requested date and time. Where a booking cancels at least 48 hours before the event, if a deposit has been paid, there will be no further charges beyond the deposit paid. If a PO number has been supplied, cancellations at least 48 hours before the event will be charged 50% of the full amount of the booking. Where a booking cancels within 48 hours before the event, the full amount of the booking will be charged.
ENTERTAINER CANCELLATION
In the unlikely event the entertainer must cancel due to unforeseen circumstances, you will receive a full refund for any monies paid to date or the option to reschedule. Action will be taken in accordance with your preference.
HEALTH AND WELLBEING
Hoopsie Dizzy classes, lessons and workshops are not fitness activities, but they are physical activities. All forms of hooping, dance and entertainment activities provided by Hoopsie Dizzy may place stress on the body and carry inherent risks of physical injury. Hoopsie Dizzy shall not be held liable for injuries sustained during a Hoopsie Dizzy event. It is up to individual participants or their guardians (where applicable) to ensure they are fit to participate and have any pre-existing injuries or conditions cleared by an AHPRA-registered medical practitioner before attending the session. Hoopsie Dizzy will not be held liable for any losses or damage to personal property during participation in Hoopsie Dizzy entertainment.
DEBT COLLECTION POLICY
If an invoice is not paid on time, Hoopsie Dizzy will send an overdue payment reminder. If payment is still not received they will send a final notice. If payment is still not received they will send a formal letter of demand. If payment is still not received they will engage QCAT to collect outstanding monies including a late fee to cover the cost incurred in debt collection.

BOOKINGS AND PAYMENTS
Payment is always required in full, in advance.
CLASSES
Classes are non-refundable but they are transferable to either another class of equivalent price (if at least 24 hours notice is given) or to another person (if at least 24 hours notice is given). If less than 24 hours notice is given, no refund or transfer will be given.
PRIVATE LESSONS
The date and location will be arranged via email or phone and confirmed in writing. Private lessons are non-refundable but they are transferable, meaning they can be postponed (with at least 24 hours advance notice) or transferred to another person (with at least 24 hours advance notice). Private lessons that are not postponed or transferred at least 24 hours in advance will be cancelled.
CANCELLATION AND POSTPONEMENT
If Hoopsie Dizzy cancels a class or private lesson, you will be offered the option (1) to receive a refund for that class or lesson, or (2) to attend a class of equivalent value within the next 6 months. Private lessons can only be postponed if you request this at least 24 hours in advance, otherwise they will be cancelled with no refund offered.

It is the responsibility of individual participants or their guardians (where applicable) to ensure they are fit to participate and have any pre-existing injuries or conditions cleared by an AHPRA-registered medical practitioner before attending the session. Such injuries or health conditions must be declared to the facilitator before commencing tuition. By attending Hoopsie Dizzy tuition, you assume the associated risks and agree that Hoopsie Dizzy, its staff and chosen facilities will not be in any way liable for injuries or damage sustained to personal property during Hoopsie Dizzy tuition. Your attendance at Hoopsie Dizzy tuition marks your agreement to follow the facilitator's instructions and not participate in unsafe practices.
LOOK AFTER YOURSELF
Hoopsie Dizzy participants are encouraged to take care of themselves when engaging in Hoopsie Dizzy activities. The following are recommendations, but you should adapt these guidelines as appropriate to your own needs. Arrive hydrated and with a water bottle. If wearing footwear, ensure it is appropriate and comfortable. Wear comfortable clothing. Avoid wearing any loose pieces of fabric, jewellery or accessories that could catch on anything. It is not recommended to eat a heavy meal before coming to class, but it is a good idea to have a light snack before participating.
ONLINE BOOKINGS
By making bookings or placing orders on the Hoopsie Dizzy website, you are agreeing that you are over 18 and will not use our products for any illegal or unauthorised purpose.
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
INDEMNIFICATION
Hooping, dance and associated practices may place stress on your body and carry with them the risk of physical injury. By purchasing Hoopsie Dizzy products, you agree that Hoopsie Dizzy and its partners will not be held in any way liable for injuries sustained through the use of Hoopsie Dizzy products.
ACCURACY OF BILLING AND ACCOUNT INFORMATION
For all purchases you make through the Hoopsie Dizzy website, you agree to provide current, complete and accurate purchase and contact information.
PRODUCT & SERVICE DESCRIPTIONS & AVAILABILITY
We have made every effort to describe our services and products as accurately as possible. All descriptions of services, products and pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product or service at any time. We do not warrant that the quality of any product, service, information, or any other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.
MODIFICATIONS TO SERVICES AND PRICES
Prices of all Hoopsie Dizzy products and services are subject to change at any time without notice. We reserve the right to modify or discontinue a product or service (or any part or content thereof) at any time. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuation of the service.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless Hoopsie Dizzy and our affiliates, partners, directors and contractors harmless for any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, or your violation of any law or the rights of a third party.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
Hoopsie Dizzy and all Hoopsie Dizzy contractors hold current Public Liability Insurance. You expressly agree that your use of and engagement with Hoopsie Dizzy products and services is at your sole risk. Hoopsie Dizzy products and services are provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind.
In no case shall Hoopsie Dizzy, our partners, directors and contractors be liable for any injury, loss, claim; or any direct, indirect, incidental, punitive, special, or consequential damages of any kind including, without limitation, lost profits, lost revenue, lost savings, replacement costs, or any similar damages, arising from your use of any Hoopsie Dizzy products or services.
